License terms of Argo Ubicom GmbH

Downloading the software application from the Apple App Store or Google Play Store constitutes a license agreement for the use of Intellilog Reader or Intellilog Dispatcher App (hereinafter "App") between you and Argo Ubicom GmbH (hereinafter "Licensor").

Neither Apple Inc. or any Apple affiliate nor Google Inc. or any Google affiliate will be party to this License Agreement. Apple and Google are, however, entitled to enforce their obligations under this license agreement against you. By downloading, you agree to the following license and usage conditions.

1. Using the App

   1. By downloading the App, Licensor grants you the royalty-free, non-exclusive, non-transferable right to use the App on any device in your possession on which the Software is executable according to system requirements, which you can view on the Apple App Store or Google Play Store prior to the conclusion of these terms and conditions.

   2. The app is constantly being developed and new functions and services can be offered beyond the free basic version. Additional functions and services within the app may be or become subject to a fee. In this case, the licensor will inform you of the prices and features in advance. In any case, the free basic functionality will remain available and usable.

   3. You are not permitted to copy, distribute or otherwise make the App available to third parties (including renting, leasing, loaning or sublicensing) or to use it in any other manner which is reserved for the respective author(s). You are not allowed to modify, reverse engineer, decompile or disassemble the source code of the App, or parts of it, or otherwise determine the source code nor to derive other works of this. However, the provisions of §§ 69d, 69e UrhG (German Copyright Act) shall remain unaffected.

   4. The above terms and conditions also apply to all updates/upgrades and program amendments for the App that are made available to you for download from the Apple App Store or the Google Play Store by the licensor, unless they are the subject of a separate license agreement. In this case, only the terms and conditions of the license agreement applicable to the respective update/upgrade or program supplement shall apply.

   5. The App may contain individual components or modules (hereinafter "Third Party Software") that are licensed by third parties under an open source license. More detailed information and the applicable license terms for this third-party software are contained in the documentation. The use of this third party software is subject to the terms and conditions stated therein.

   6. The licensor reserves all rights to the app.

2. Functions and services of the app

   1. Please note that the use of certain functionalities of the app will require an available Internet connection on your mobile device or that this connection will be established by using these functionalities. Costs arising from this are not covered by the licensor.

   2. The app allows you to communicate with the Intellilog logger via NFC. If the app is the Intellilog Dispatcher, you can configure and start the Intellilog Logger with the app. With the Intellilog Reader you can read the data of the Intellilog logger using the app. For information on the available functions, see the respective app and its service description.

   3. With the Intellilog Reader you also have the possibility to transfer the read out data to the Intellilog Manager. To use this feature, you need to create a user account (registration) in the Intellilog Manager under https://manager.intellilog.io/en/login. To transfer the read out data, you must log in with your user name and password (hereinafter "credentials").

   4. You must keep the credentials secret and must not pass them on to third parties. In the event that the login data is lost or if you suspect that third parties have gained access to your login data, you are obliged to notify the Licensor immediately using the contact details provided in the App and to change the password. You are liable to the licensor for any misuse by third parties.
